1- Acceptance of terms of use<\/h3>

This is an agreement between Pavillon chasse & p\u00eache Inc. (” Pavillon chasse & p\u00eache<\/b>“, ” our<\/b> ” or ” we<\/b> “), the owner and operator of the website accessible at pavillongranby.ca (the ” Site<\/b> “) and you (” you<\/b> “). <\/p>

By accessing the Site or using the services made available to you (the “Services”), you acknowledge and agree to be bound by (i) these Terms of Use (the “Terms of Use”); and (ii) the Hunting and Fishing Lodge Privacy Policy (the “Policy”). If you choose not to accept these Terms of Use or the Policy, you must refrain from browsing the Site, consulting its content or otherwise using the Services. <\/p>

These Terms of Use and the Policy constitute the entire agreement between you and Pavillon chasse et p\u00eache with respect to your use of the Site and the Services, which shall remain in effect for an indefinite term commencing at the time you access the Site.<\/p>

Services are reserved for people who have reached the age of majority in their province of residence, as provided for by applicable laws.<\/p>

2- Modification of conditions of use<\/h3>

Pavillon chasse et p\u00eache reserves the right, at its sole discretion, to modify, add or remove any part of these Terms of Use without prior notice. It is your responsibility to regularly review the Terms of Use posted by Pavillon chasse et p\u00eache and any changes thereto. By browsing the Site afterwards, you are deemed to have accepted any changes to the Terms of Use published at that time. <\/p>

3- Site and services<\/h3>
  1. Modification.<\/b> Pavillon chasse et p\u00eache reserves the right, at any time, to modify or interrupt access to or the content of the Site or Services (or any part thereof) without notice. Pavillon chasse et p\u00eache shall not be liable to you or to any third party for any such modification, suspension or discontinuance. <\/li>
  2. Availability.<\/b> Pavillon chasse et p\u00eache cannot guarantee the availability of the Site or the Services.<\/li>
  3. Controls.<\/strong> Pavillon Chasse et P\u00eache reserves the right, at its sole discretion, to cancel any order placed on the Site, particularly in the event of a pricing error, product availability, suspicion of fraud or non-compliance with applicable laws. In such a case, a full refund will be made according to the original method of payment. <\/li>
  4. Compatibility.<\/b> Pavillon chasse et p\u00eache does not warrant that the Site or Services will be compatible with, or remain compatible with, the browser or device you are using. Without limiting the generality of the foregoing, you are solely responsible for obtaining the software necessary to use the Services and view the content of the Site. <\/li>
  5. Limits.<\/b> Pavillon chasse et p\u00eache does not warrant that the content of the Site or the quality of the Services will meet your expectations or that any errors therein will be corrected.<\/li><\/ol>

    4- Use<\/h3>
    1. Functionality.<\/b> The Site and Services allow you to obtain information on our products and services, to start a chat with an advisor to find out about your various purchases and to make an appointment at a branch.<\/li>
    2. More information.<\/b> The information available through the Site or the Services is subject to the terms and conditions set forth in the relevant contracts, if any.<\/li>
    3. Pavillon chasse et p\u00eache grants you a limited, non-exclusive, non-transferable right to access and use the Site and Services solely for lawful purposes in accordance with the Terms of Use (” Permitted Purposes<\/b> “). Without limiting the generality of the foregoing, you are prohibited from engaging in the following prohibited activities in connection with your access to the Site or use of the Services:
      1. copy, distribute or disclose all or any part of the Site or Services or any content therein in any medium whatsoever, including by means of any automated or non-automated web scraping tool or technique;<\/li>
      2. use any automated system, including robots and offline readers, to access the Site or Services;<\/li>
      3. transmit, by means of the Services, spam or any other form of unsolicited electronic communication;<\/li>
      4. attempt to interfere with the servers hosting the Site and Services, compromise the integrity or security of their systems or decrypt a transmission to or from them;<\/li>
      5. take any action which, in the sole discretion of the Hunting and Fishing Pavilion, imposes or is likely to impose an unreasonable or disproportionately burdensome burden on the Hunting and Fishing Pavilion’s systems;<\/li>
      6. upload data, viruses, worms or other malware;<\/li>
      7. collect, extract or harvest information that can be used to identify individuals;<\/li>
      8. test the vulnerability of systems at the Hunting and Fishing Pavilion;<\/li>
      9. impersonate any person, or otherwise misrepresent your affiliation with a person or entity, commit fraud, or conceal or attempt to conceal your identity;<\/li>
      10. interfere with the proper working of the Site or Services;<\/li>
      11. access any content using any means or technology other than those provided or authorized by the Hunting and Fishing Pavilion; or<\/li>
      12. circumvent measures that the Hunting and Fishing Lodge may use to prevent or restrict access to the Site or Services, including features that prevent or restrict the use or copying of content or that impose limits on use.<\/li><\/ol><\/li>
      13. Usage Monitoring <\/b>Pavillon chasse et p\u00eache logs events related to security or that are of interest for audit or statistical purposes, including, but not limited to, all accesses to the Site or Services (or any section thereof), all communications sent or received by a user (in the case of electronic messaging integrated with the Services), as well as any other activity related to the Services, if applicable.<\/li>
      14. Investigation and prosecution.<\/b> Pavillon chasse et p\u00eache shall have the right to investigate and seek legal remedies for any violation of the Terms of Use to the fullest extent permitted by law.<\/li><\/ol>

        5- Your account<\/h3>
        1. Create an account.<\/b> Use of the Services may require the creation of a user account. When creating a user account, you agree to provide true and complete information about yourself as required by the registration process, and to update such information as necessary to keep it accurate at all times. You must also choose a unique and secure password. In the event of a breach of this paragraph 5.1, Pavillon chasse et p\u00eache reserves the right to suspend or terminate your right to use the Services without notice, at its sole discretion. <\/li>
        2. Responsibility for your account. <\/b>You are entirely responsible for maintaining the confidentiality of your password and user name. Furthermore, you are entirely responsible for any and all activities that occur under your account. You agree to immediately notify Fish and Game Pavilion of any unauthorized activity that occurs under your account or any other breach of security. <\/li>
        3. Account security.<\/b> Pavillon chasse et p\u00eache has implemented appropriate security measures to protect the Site and Services. However, Pavillon chasse et p\u00eache cannot guarantee that unauthorized third parties will never succeed in circumventing these security measures or that they will not make illicit use of information that you have provided and that makes it possible to identify you (“Personal Information”). You acknowledge that you provide Personal Information at your own risk. <\/li>
        4. Liability for account misuse.<\/b> Fish & Game Pavilion shall not be responsible or liable, directly or indirectly, for any loss or damage of any sort incurred by you as a result of someone else using, with or without your knowledge, your password or user name, or your account. You may also be held liable for losses incurred by Pavillon chasse et p\u00eache or a third party due to someone else using your account, username or password. <\/li>
        5. Use of other accounts.<\/b> You are prohibited from using another person’s account at any time, except with the permission of the account holder as their authorized agent.<\/li>
        6. Account suspension.<\/b> If Pavillon chasse et p\u00eache determines that you have violated these Terms of Use, Pavillon chasse et p\u00eache reserves the right to suspend or terminate access to your account without prior notice. Pavillon chasse et p\u00eache reserves the right to reactivate access to your account at its sole discretion. Pavillon chasse et p\u00eache may also suspend or deactivate your account if you infringe any third-party intellectual property rights or if we are required to do so by law. We invite you to contact Pavillon chasse et p\u00eache to try to resolve the problem and obtain the reactivation of your account as soon as possible. <\/li><\/ol>
          <\/div>

          6- Intellectual property<\/h3>
          1. Intellectual property.<\/b> All content of the Site and Services or any related documentation, including but not limited to trademarks, texts, logos, slogans, designs, graphics, images, photographs, videos, musical excerpts, downloads, technological programs and business processes, is the exclusive property of <\/a>Pavillon chasse et p\u00eache <\/u>or is otherwise provided or used under license by Pavillon chasse et p\u00eache. All content of the Site and Services is subject to the intellectual property rights of Fish and Game Pavilion, or their owner, as the case may be, under the applicable laws of Canada or other countries and international treaties. Any unauthorized use of this content, including but not limited to any reproduction, distribution, transmission or communication to the public without the prior written consent of Pavillon chasse et p\u00eache is strictly prohibited. <\/li>
          2. Trademarks.<\/b> Without limiting the generality of the foregoing, you acknowledge that all trademarks displayed on the Site or in the Services (whether registered or unregistered) are the exclusive property of Pavillon chasse et p\u00eache or third parties and may not be used without the prior written consent of their respective owners.<\/li>
          3. No right.<\/b> Nothing contained on the Site or Services shall be construed as granting, by implication or otherwise, any license or right to use or reproduce any intellectual property contained therein without the prior written consent of the owner of such intellectual property.<\/li>
          4. Feedback.<\/b> You agree that by providing or submitting by any means of transmission any material to Pavillon chasse et p\u00eache, including your suggestions, ideas and comments, you are granting Pavillon chasse et p\u00eache permission to use such material in connection with the operation of its business. No compensation will be paid for the use of such material and Pavillon chasse et p\u00eache will have no obligation to publish or use it. <\/li><\/ol>

            7- Consent to electronic communications<\/h3>

            When you provide Pavillon chasse et p\u00eache with your e-mail address through the Services, you expressly consent to Pavillon chasse et p\u00eache retaining your e-mail address in its databases or using your e-mail address in its mailing lists in order to contact you to (i) conduct surveys or verifications regarding the Services, (ii) send you information and news about Pavillon chasse et p\u00eache’s products and services, or (iii) for any other reason relating to the Services or their security. <\/p>

            8- Hyperlinks<\/h3>

            The Site or Services may include hyperlinks to external websites owned and operated by third parties (an ” External Website<\/b> “), and you acknowledge that (i) Fish and Game Pavilion has no control over External Websites and makes no representation or warranty regarding their content; and (ii) you are entirely responsible for any and all risks arising from your access to or use of External Websites, all of which are expressly disclaimed by Fish and Game Pavilion. For the sake of clarity, the inclusion of a hyperlink to an External Website should in no way be construed as an endorsement by Pavillon chasse et p\u00eache of the content of such External Website or as implying any association, affiliation or other type of partnership with its owner. <\/p>

            9- No warranty<\/h3>

            The Site, the Services and their content are provided to you “as is”, without warranties of any kind. To the fullest extent permissible pursuant to applicable law, Pavillon chasse et p\u00eache disclaims all warranties, express or implied, including warranties as to non-infringement, accuracy, freedom from error or currency of content. <\/p>

            10- Limitation of liability<\/h3>

            You acknowledge and agree that you assume all risk arising from your access to the Site or use of the Services, whether such use is lawful or unlawful. To the fullest extent permitted by applicable law, Pavillon chasse et p\u00eache, its affiliates, directors, employees, agents, licensors or successors and assigns, shall not under any circumstances be liable for damages of any kind, including but not limited to loss of use, loss of profits or loss of data, whether in an action in contract or tort, or otherwise, arising directly or indirectly from your access to the Site or your use of the Services, including any damage caused by or resulting from a person’s reliance on any information obtained in connection therewith, or resulting from any error, omission, interruption, deletion of files or e-mails, defect, virus, delay in operation or transmission or any failure of performance. <\/p>

            11- Compensation<\/h3>

            By accessing the Site or using the Services, you agree to defend, indemnify and hold harmless Pavillon chasse et p\u00eache, its affiliates and related companies, and their respective officers, agents, directors, employees, licensors and assigns, from and against any and all claims, demands, damages, obligations, losses, liabilities, costs, debts, expenses (including reasonable out-of-court fees and legal disbursements) and amounts paid in settlement arising out of or otherwise related to (i) your access to or use of the Site or the Services; (ii) your breach of the Terms of Use; or (iii) your violation of any rights of a third party. Pavillon chasse et p\u00eache may assume the exclusive defense and control of any matter for which you have agreed to indemnify Pavillon chasse et p\u00eache and you agree to assist and cooperate with Pavillon chasse et p\u00eache in the defense or settlement of any such matter. <\/p>

            12- General<\/h3>
            1. Interpretation.<\/b> In these Terms of Use (i) headings are used for convenience of reference only and shall not affect the meaning or scope of the provisions to which they refer; (ii) all words and terms used shall be construed as including the masculine and feminine, singular and plural, according to the context or meaning of the convention; (iii) “or” is used in the inclusive sense of “and\/or”; and (v) the expressions “hereof”, “hereto”, “hereunder”, “hereby”, “hereby”, and any other similar expressions generally refer to these Terms of Use as a whole rather than to any part thereof, unless otherwise indicated in the text. <\/li>
            2. Other conditions of use.<\/b> You acknowledge that you are responsible for complying with any additional specific terms of use applicable to certain third-party programs, offers, promotions, content or software, which will be communicated to you when you access such third-party programs, offers, promotions, content or software.<\/li>
            3. Applicable laws.<\/b> These Terms of Use and the Policy shall be governed by the laws of the Province of Quebec and the laws of Canada applicable therein, excluding its conflict of law provisions. You agree that any dispute relating to the interpretation or application of these Terms of Use or the Policy shall be subject to the exclusive jurisdiction of the courts of the judicial district of Montreal, Quebec.<\/li>
            4. Assignment.<\/b> You may not assign or transfer these Terms of Use and the Policy or any rights or obligations hereunder.<\/li>
            5. Waiver.<\/b> The failure or delay of the Hunting and Fishing Lodge to exercise any right, remedy, power or privilege under the Terms of Use shall not constitute a waiver of such right, remedy, power or privilege. To be valid, a waiver must be made in writing and must be signed by the Hunting and Fishing Pavilion . A written waiver of a defect shall not be construed as a waiver of any other defect or defect of a similar nature that may arise in the future.<\/li>
            6. Invalidity or unenforceability.<\/b> Even if one or more provisions of the Terms of Use or the Policy are declared invalid or unenforceable by a court of competent jurisdiction, such invalidity or unenforceability shall not affect the validity or enforceability of the remaining provisions hereof or of the Policy, and the Terms of Use or the Policy shall be construed as if the invalid or unenforceable provision had never been a part hereof.<\/li><\/ol>
